Terms of Service

These Terms govern your purchase and use of Avette from bearcove SARL. By buying, installing, activating, or using Avette you agree to these Terms. If you do not agree, do not buy or use Avette.

1. Who we are

Avette is sold by bearcove SARL, a French société à responsabilité limitée, RCS Lyon 934 149 618, registered at 4 Quai Jean Moulin, c/o La Cordée SAS, 69001 Lyon, France. Contact: hi@bearcove.eu.

2. What you’re buying

Avette is a macOS dictation application. A license is a one-time purchase of €50 (VAT included where applicable) of a lifetime license for version 1 of Avette that:

  • is perpetual for the version you buy — once activated, it keeps working;
  • may be activated on up to 15 devices (you can deactivate a device to free a slot; for more, write to us);
  • includes free updates within the current major version.

Before buying, you can use Avette at no charge: until a license is activated, it dictates only into its own window.

3. Orders, prices, and payment

Prices are shown in euros and include applicable VAT. Payment is processed by our payment provider, Mollie; bearcove is the seller of record. Your order is confirmed once payment is completed, after which we email your license key and a VAT invoice.

4. Delivery

Avette is digital content. After purchase, your license key is delivered by email and the app is available to download from this website. There is no physical shipment.

5. Refunds and right of withdrawal

We keep this simple: if you’re not happy with Avette, email hi@bearcove.eu within 30 days of your purchase and we’ll refund you — no need to explain yourself. You can also try Avette before buying (§2).

Separately, EU consumers have a statutory 14-day right of withdrawal for distance purchases. Because Avette is digital content supplied immediately, you are asked at checkout to consent to immediate supply and to acknowledge that this statutory right may end once delivery begins (Article L221-28 of the French Consumer Code, transposing the EU Consumer Rights Directive). Our 30-day refund offer above is more generous than, and does not limit, your statutory rights.

6. License grant

Subject to payment and these Terms, bearcove grants you a non-exclusive, non-transferable, revocable license to install and use Avette for speech-to-text dictation on macOS, on up to the number of devices covered by your purchase. Avette is licensed, not sold.

7. License keys and activation

Avette is unlocked with a license key issued on purchase. Activation and validation are performed by bearcove’s licensing service (see the Privacy Policy). Keep your key confidential; do not publish, share, or resell it beyond your purchased devices.

8. Restrictions

You may not, except to the extent applicable law expressly permits:

  • copy (other than for normal use and backup), distribute, sublicense, rent, lease, lend, sell, or otherwise make Avette available to third parties;
  • reverse engineer, decompile, or disassemble Avette, except where mandatory law permits (for example, for interoperability under applicable EU law);
  • circumvent or tamper with license enforcement, or use a key beyond your devices;
  • remove or alter any proprietary notices; or
  • use Avette in violation of applicable law.

9. Updates

We may, but are not obliged to, provide updates. Updates to your licensed version are provided under these Terms. Major new versions may be offered as separate paid products.

10. Third-party components

Avette includes open-source components and an open-weights speech-recognition model (Qwen3-ASR, Apache License 2.0), each under its own terms, reproduced in the in-app Acknowledgements, which prevail for those components.

11. Disclaimer of warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Avette IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. We do not warrant that Avette will be error-free or uninterrupted, or that transcriptions will be accurate. Nothing in this section limits warranties or rights that cannot be excluded under mandatory law, including the statutory guarantee of conformity owed to consumers under French law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, bearcove’s aggregate liability arising out of or relating to Avette or these Terms shall not exceed the amount you paid in the twelve (12) months before the event giving rise to the claim. bearcove shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. This does not exclude liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot be excluded under mandatory law.

13. Term and termination

These Terms apply for as long as you use Avette, and terminate automatically if you breach them. On termination you must stop using and remove Avette. Sections 6, 8, 11, 12, and 14 survive termination.

14. Governing law and disputes

These Terms are governed by French law. The courts of Lyon, France have jurisdiction, except where mandatory consumer-protection rules let a consumer bring proceedings in, or require the law of, their country of residence. Consumers may also use the EU Online Dispute Resolution platform.
